How Do I Prove Liability in a Dog Bite Case?
Dog bite cases are often difficult to prove because the victim is, by definition, an "invitee"—someone who is on another person's property with permission. The property owner is always responsible for keeping their premises reasonably safe, even if the invitee is a guest.
Under Ohio law, dog owners are liable for any damages their pets cause if:
- The dog had a known history of violence or aggression and the owner did not take adequate steps to prevent the dog from harming others
- The dog was not confined to the owner's property and the victim was lawfully on the property when the attack occurred
- The dog was being used as a guard dog and the victim was trespassing
If the dog owner can prove that the victim was trespassing or otherwise unlawfully on their property at the time of the attack, they may not be liable for damages. However, a dog owner can never claim that their dog was "defending itself" if the victim was lawfully on the property.
What Damages Can I Recover in a Dog Bite Case?
Victims of dog bites often suffer a wide range of catastrophic injuries. These injuries can require multiple surgeries and ongoing medical care, as well as limit their ability to work and live independently. In these cases, our attorneys are prepared to fight for the full compensation our clients deserve.
Some of the damages our Youngstown dog bite lawyers can seek on your behalf include:
- Medical care and expenses
- Lost wages
- Loss of future earning capacity
- Loss of household services
- Pain and suffering
- Physical and emotional trauma
- Punitive damages
In some cases, punitive damages may be available if the dog owner acted with extreme negligence or malice. In these instances, the dog owner's insurance company may fight our team's efforts to obtain full compensation. However, we are always prepared to aggressively advocate for the best interests of our clients.
